SHAKA SURF MOROCCO – EXCLUSIVE GROUP BOOKING TERMS & CONDITIONS

These Group & Retreat Booking Terms and Conditions (“Terms”) apply to bookings made by retreat hosts, sports clubs, coaches, companies, event organisers, families, private groups and other group organisers (“Host”, “you” or “your”) who book accommodation and/or services at Shaka Surf Morocco (“Shaka”, “we”, “us” or “our”).

By confirming a group booking with Shaka, the Host accepts these Terms on behalf of the booking group and agrees to ensure that all participants are informed of any rules or requirements that apply to their stay.


1. Group Bookings

These Terms apply to group bookings for retreats, sports camps, surf camps, club trips, training weeks, family groups and similar organised stays.

Group and retreat bookings are subject to a minimum booking value equivalent to 8 participants.

A group booking is considered confirmed only when:

  • Shaka has accepted the booking in writing;

  • the Host has accepted these Terms; and

  • the required non-refundable deposit has been received by Shaka.

A quotation or provisional booking does not guarantee availability. Shaka may release provisional dates or rooms if the required deposit is not received by the agreed deadline.

The Host is the contracting party responsible for the booking and for payment of all amounts due to Shaka.

Unless otherwise agreed in writing, Shaka does not contract individually with each participant for the accommodation or services included in the group booking.


2. Minimum Booking Value

The minimum booking value for an exclusive group or retreat booking is equivalent to 8 participants, based on the agreed per-person rate and services included in the booking.

This minimum booking value applies regardless of the final number of participants attending.

For example, if the agreed rate is €500 per participant, the minimum booking value would be €4,000, representing 8 participants.

If the Host brings more than 8 participants, the total booking value will be calculated based on the agreed number of participants and the services confirmed with Shaka.

If the final number of participants falls below 8, the Host remains responsible for the minimum booking value equivalent to 8 participants.

Individual participants dropping out of the group do not automatically reduce the amount payable by the Host below this minimum booking value.


3. Exclusive Use of the Property

Where the booking is for exclusive use of Shaka Surf Morocco, the accommodation will be reserved exclusively for the Host and the registered participants for the agreed dates.

The Host may not invite additional overnight guests or other visitors to the property without Shaka’s prior agreement.

Exclusive use of the accommodation does not automatically grant permission to hold parties, public events or other commercial activities at the property.

Any event, retreat programme, workshop, class or other organised activity taking place at the property must be discussed with and agreed by Shaka in advance where required.

The Host and participants must respect the property, neighbours and the local community throughout their stay.


4. Booking Details

The booking confirmation will specify, where applicable:

  • arrival and departure dates;

  • number of nights;

  • estimated or confirmed number of participants;

  • room allocation;

  • accommodation type;

  • agreed per-person rate;

  • minimum booking value;

  • meals included;

  • surf, yoga, sports or other activities included;

  • transfers or excursions included;

  • total booking value;

  • payment schedule; and

  • any special conditions agreed between Shaka and the Host.

The booking confirmation and any written amendments agreed by both parties form part of the booking agreement.

If there is any difference between a quotation and the final booking confirmation, the final booking confirmation will prevail.


5. Prices

Prices are confirmed in the booking confirmation and are based on the information available at the time of booking.

Unless expressly stated otherwise, the price does not include:

  • flights;

  • travel to or from Morocco;

  • travel insurance;

  • personal insurance;

  • visas or entry requirements;

  • personal expenses;

  • alcoholic drinks;

  • optional activities;

  • medical expenses;

  • equipment not expressly included in the booking; or

  • any other item specifically excluded from the booking confirmation.

Any additional services requested after confirmation will be charged separately.

If government taxes, fees or charges applicable to the services change after the booking is confirmed, Shaka reserves the right to pass on the direct cost of such changes where legally permitted.


6. Payment Terms

Group and retreat bookings are payable in two instalments.

First payment – Non-refundable deposit

A 30% non-refundable deposit is required to secure the booking and confirm the agreed dates.

The deposit is calculated based on the agreed booking value, subject to the minimum booking value equivalent to 8 participants.

For example, if the agreed booking value is €4000, the deposit required to confirm the booking will be €1,200.

The booking is not confirmed until the deposit has been received by Shaka.

The deposit is non-refundable if the Host subsequently cancels the booking, subject to any rights that cannot legally be excluded under applicable law.

Second payment – Remaining balance

The remaining 70% balance is payable no later than 30 days before the arrival date.

The final balance will be based on the agreed booking value and confirmed number of participants, subject to the minimum booking value equivalent to 8 participants.

Any additional participants confirmed before the final balance is due will be added to the total booking value and reflected in the remaining balance.

For bookings made less than 30 days before arrival, Shaka may require the full booking amount to be paid at the time of confirmation.

All payments must be received in cleared funds by the applicable due date.

Bank charges, transfer fees and currency conversion costs are the responsibility of the Host unless otherwise agreed.

Shaka is not responsible for delays caused by banking systems, payment providers or international transfers.


7. Final Participant Numbers

The Host must confirm the final number of participants no later than 30 days before arrival.

The final booking value will then be confirmed based on the agreed rate and final participant numbers, subject to the minimum booking value equivalent to 8 participants.

If the final number is fewer than 8, the minimum 8-participant booking value remains payable.

If the final number is greater than the original booking number, additional participants may be added subject to availability and the maximum capacity of the property.

Additional participants will be charged at the agreed rate or any other rate confirmed in writing by Shaka.

Once final participant numbers have been confirmed, reductions in group size may be treated as cancellations and may be subject to the cancellation terms below.


8. Guest List & Information

The Host must provide the final guest list, rooming information and relevant participant details no later than 14 days before arrival.

The Host must also inform Shaka of any relevant:

  • dietary requirements;

  • food allergies;

  • mobility requirements;

  • medical or safety information; or

  • other requirements that may reasonably affect the provision of accommodation or activities.

The Host is responsible for ensuring that information provided to Shaka is accurate and up to date.


9. Late or Non-Payment

If the remaining balance is not received by the due date, Shaka will notify the Host and may provide a short period to remedy the missed payment.

If payment remains outstanding, Shaka may, subject to applicable law:

  • suspend or cancel the booking;

  • release rooms or services held for the group;

  • retain amounts already paid where permitted under these Terms; and

  • charge the applicable cancellation fees.

Shaka is not obliged to hold availability for a group whose payments are overdue.


10. Cancellation by the Host

All cancellations must be made in writing.

Because group bookings require Shaka to reserve accommodation, staff, food, activities and other resources specifically for the group, cancellation charges apply.

The initial 30% deposit is non-refundable.

If the Host cancels the booking, the following cancellation charges will apply to the total booking value:

  • Cancellation received: More than 60 days before arrival > Cancellation charge: 30% of total booking value

  • Cancellation received: 30–59 days before arrival > Cancellation charge: 50% of total booking value

  • Cancellation received: Less than 30 days before arrival > Cancellation charge: 100% of total booking value

  • No-show or failure to arrive > Cancellation charge: 100% of total booking value

Where the applicable cancellation charge is greater than the amounts already paid, the Host remains responsible for paying the outstanding cancellation charge.

These charges reflect the costs and losses that Shaka may incur by reserving accommodation and services for a group and turning away other potential bookings.

The Host is responsible for arranging its own cancellation or travel insurance if it wishes to protect against losses arising from cancellation.


11. Reduction in Group Size

A reduction in participant numbers is treated separately from cancellation of the entire booking.

The booking remains subject to the minimum booking value equivalent to 8 participants.

If the final number of participants is fewer than 8, the Host remains responsible for the minimum booking value.

If the final number of participants is greater than 8, the total booking value will be adjusted to reflect the confirmed number of participants and any additional services.

After final participant numbers have been confirmed, reductions in group size may be treated as cancellations and may be subject to the cancellation charges in Section 10.

A participant who cancels or fails to attend does not automatically create a right to a refund from Shaka.

The Host is responsible for managing any refunds or payments between the Host and its own participants.


12. Substitution of Participants

Where practical, the Host may replace a participant who can no longer attend with another participant.

The Host must provide Shaka with the replacement participant’s details before arrival.

Any replacement participant must comply with Shaka’s booking requirements, house rules and safety requirements.

Shaka may refuse a replacement where there are legitimate operational, safety, legal or accommodation reasons for doing so.


13. Participants Under 18

Group bookings are generally intended for adults.

Participants under the age of 18 may only be accepted where this has been expressly agreed in writing with Shaka before the booking is confirmed.

Where minors are accepted, the Host is responsible for ensuring that appropriate supervision and safeguarding arrangements are in place and that all applicable requirements are met.

Shaka reserves the right to refuse accommodation to any participant who does not meet the agreed booking requirements.


14. Arrival and Departure

Standard check-in and check-out times will be stated in the booking confirmation.

The Host must provide Shaka with the final guest list and relevant rooming information no later than 14 days before arrival.

Early arrivals, late departures and additional nights are subject to availability and may incur additional charges.

The Host should provide Shaka with the group’s approximate arrival time in advance so that we can make appropriate arrangements for check-in.


15. Accommodation and Room Allocation

Shaka will provide the accommodation described in the booking confirmation.

Room allocation may be adjusted where necessary for reasonable operational reasons, provided that Shaka makes reasonable efforts to maintain the agreed standard of accommodation.

Requests for specific rooms, beds or room-sharing arrangements are subject to availability and are not guaranteed unless expressly confirmed in writing.

The Host is responsible for communicating room-sharing arrangements to participants.


16. Meals and Dietary Requirements

Where meals are included, they will be provided according to the meal plan stated in the booking confirmation.

The Host must provide complete and accurate dietary and allergy information no later than 14 days before arrival.

Shaka will make reasonable efforts to accommodate notified dietary requirements but cannot guarantee an allergen-free environment.

Participants with serious allergies or medical dietary requirements remain responsible for taking appropriate precautions and informing Shaka directly on arrival.


17. Surfing, Sports and Other Activities

Where surfing, sports, yoga, excursions or other activities are included, activities are subject to suitable conditions, availability and safety considerations.

Shaka may modify, postpone or cancel an activity where conditions are considered unsafe or where circumstances outside Shaka’s reasonable control prevent the activity from taking place.

Examples include:

  • dangerous sea conditions;

  • extreme weather;

  • insufficient or unsuitable surf conditions;

  • equipment failure;

  • local restrictions;

  • safety concerns;

  • illness or injury of essential staff; or

  • other circumstances beyond Shaka’s reasonable control.

Where possible, Shaka will seek to provide a reasonable alternative.

No refund is automatically due where an activity cannot take place because conditions make it unsafe or impractical, particularly where Shaka has offered a reasonable alternative.


18. Responsibilities of the Host

The Host is responsible for the conduct and organisation of its group.

The Host must:

  • provide participants with relevant information before arrival;

  • ensure participants understand and follow Shaka’s house rules;

  • ensure participants behave respectfully towards Shaka staff, other guests and neighbours;

  • ensure participants follow all safety instructions;

  • ensure the group does not cause unreasonable disturbance;

  • ensure participants have appropriate travel and personal insurance; and

  • ensure that any retreat, sports programme or other activity organised by the Host complies with applicable laws and regulations.

Where the Host is organising its own retreat, classes, coaching, therapy, sports training or other programme, the Host is responsible for that programme unless Shaka has expressly agreed in writing to provide it.


19. Damage, Loss and Excessive Cleaning

The Host is responsible for damage caused by members of its group to Shaka’s property, furnishings, equipment or facilities, except for normal wear and tear.

The Host may also be responsible for reasonable additional cleaning costs resulting from unusual or excessive mess caused by the group.

Examples may include:

  • damaged furniture or equipment;

  • broken fixtures;

  • stained mattresses or bedding;

  • damage to surfboards or other equipment;

  • lost keys;

  • smoking in prohibited areas; or

  • excessive cleaning required beyond normal housekeeping.

Shaka will notify the Host of any significant damage or additional charges and, where reasonably possible, provide details of the cost of repair or replacement.


20. House Rules and Behaviour

All participants must comply with Shaka’s house rules and reasonable instructions from Shaka staff.

Shaka may require a participant to leave the property without refund where that person:

  • behaves aggressively or abusively;

  • threatens or harasses staff or other guests;

  • causes serious or repeated disturbance;

  • deliberately damages property;

  • engages in illegal activity;

  • creates a serious safety risk; or

  • repeatedly refuses to comply with reasonable house rules.

Where appropriate, Shaka will notify the Host before taking such action.

The Host remains responsible for any resulting costs or losses caused by the participant, where legally permitted.


21. Alcohol, Drugs and Illegal Activity

Illegal drugs and illegal activity are strictly prohibited at Shaka.

The Host and all participants must comply with Moroccan law and Shaka’s property rules concerning alcohol and other substances.

Shaka may take immediate action where a participant’s conduct presents a serious safety or legal risk.

Participants must not take part in surfing, sports activities or other activities while under the influence of alcohol or drugs.


22. Personal Belongings

Participants are responsible for their own belongings, valuables, travel documents and equipment.

Shaka is not responsible for loss, theft or damage to personal belongings except to the extent that liability cannot legally be excluded.

Participants should not leave valuable items unattended.


23. Insurance

The Host and all participants are strongly advised to have appropriate travel insurance covering, where relevant:

  • cancellation;

  • medical expenses;

  • personal accident;

  • surfing and sports activities;

  • repatriation;

  • lost or stolen belongings; and

  • personal liability.

Shaka does not provide travel insurance for the Host or participants unless expressly stated in writing.

The Host is responsible for ensuring that its own insurance arrangements are appropriate for the activities it organises.


24. Medical and Safety Information

Participants must inform Shaka of any relevant medical, mobility, dietary or other information that may reasonably affect the safe provision of the services.

Participants remain responsible for determining whether they are physically and medically able to participate in surfing, sports or other activities.

Shaka may refuse participation in an activity where, in its reasonable opinion, a participant presents a significant safety risk to themselves or others.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.


25. Changes by Shaka

Shaka will make reasonable efforts to provide the accommodation and services confirmed in the booking.

Occasionally, circumstances may require Shaka to make changes.

Where a significant change is necessary, Shaka will inform the Host as soon as reasonably practical and will seek to provide a reasonable alternative of a similar standard where possible.

Shaka will not be responsible for changes or interruptions caused by circumstances outside its reasonable control.


26. Force Majeure

Neither party will be liable for failure or delay in performing its obligations where this is caused by circumstances beyond its reasonable control.

Such circumstances may include, depending on the circumstances:

  • natural disasters;

  • extreme weather;

  • fire;

  • government restrictions;

  • war or civil unrest;

  • serious public health emergencies;

  • major transport disruption;

  • closure of facilities;

  • utility failures;

  • strikes or industrial disputes; or

  • other events that could not reasonably have been prevented or overcome.

The affected party will notify the other party as soon as reasonably possible.

The parties will seek to agree a reasonable solution, which may include changing dates, modifying services or applying a credit where commercially and legally appropriate.


27. Liability

Shaka will provide the accommodation and agreed services with reasonable care.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

Subject to the foregoing, Shaka will not be responsible for loss arising from:

  • the Host’s own acts or omissions;

  • a participant’s acts or omissions;

  • activities organised independently by the Host;

  • failure to follow safety instructions or house rules;

  • personal travel arrangements;

  • flights or transport not booked by Shaka;

  • loss of personal belongings; or

  • circumstances outside Shaka’s reasonable control.

The Host remains responsible for its own contractual relationship with its participants and for any obligations it assumes towards them.


28. Complaints

Any problem relating to accommodation or services should be reported to Shaka as soon as reasonably possible during the stay.

This gives Shaka a reasonable opportunity to investigate and, where possible, correct the issue.

Complaints should initially be made to the Shaka representative responsible for the group.

If the matter cannot be resolved during the stay, the Host should submit the complaint in writing within 14 days after departure, providing relevant details and supporting evidence.


29. Photography and Media

Shaka may take photographs or videos during surf sessions, activities and around the property for use on its website and social media.

Where identifiable images of participants are intended to be used for promotional purposes, Shaka will take reasonable steps to respect individual requests not to be featured.

The Host should inform participants that photography and filming may take place during their stay and communicate any specific requests to Shaka.

A participant may request not to be included in promotional photography or video.


30. Data and Guest Information

The Host may need to provide Shaka with participant information necessary to operate the booking.

The Host confirms that it has the right to provide such information to Shaka and will only provide information reasonably necessary for the booking and delivery of services.

Shaka will handle personal information in accordance with applicable data-protection requirements and its privacy policy.


31. Assignment and Transfer

The Host may not transfer the group booking or its contractual rights and obligations to another organisation without Shaka’s prior written agreement.

Shaka may use employees, contractors and suppliers to provide the agreed services.


32. Entire Agreement

The booking confirmation, these Terms and any written amendments expressly agreed by Shaka constitute the agreement between Shaka and the Host concerning the group booking.

Any special arrangement or exception to these Terms must be agreed in writing by an authorised representative of Shaka.

If there is any conflict between these Terms and a specific written agreement made for a particular booking, the specific written agreement will take precedence.


33. Governing Law and Jurisdiction

These Terms and the relationship between Shaka and the Host shall be governed by the laws of Morocco, unless applicable mandatory law provides otherwise.

The parties will first attempt to resolve any dispute amicably.

If a dispute cannot be resolved amicably, it shall be submitted to the competent courts in Morocco, subject to any mandatory jurisdictional rules that may apply.


34. Acceptance

By paying the non-refundable deposit or otherwise confirming the group booking, the Host confirms that it:

  • has read and accepted these Terms;

  • has authority to enter into the booking on behalf of the organisation or group;

  • accepts responsibility for payment of the booking;

  • understands that group bookings are subject to a minimum booking value equivalent to 8 participants;

  • understands that the initial 30% deposit is non-refundable;

  • understands that the remaining 70% balance is due 30 days before arrival;

  • understands that final participant numbers must be confirmed 30 days before arrival;

  • agrees to provide the final guest list and relevant participant information 14 days before arrival;

  • understands and agrees to Shaka’s house rules and safety requirements;

  • agrees to communicate relevant Shaka rules and requirements to participants; and

  • agrees that the booking is subject to these Terms and the booking confirmation.
